Terms & Conditions

We are Traveling with Charisma and are excited to help you with your travel. The following terms & conditions (the "Agreement") describe what you can expect from us. The terms "we", "us", and "our" refer to Traveling with Charisma and the term "you" refers to the individual who signs this agreement.
 By booking your arrangement with us, you are agreeing to be bound by the terms of this agreement (“Agreement”) and any additional terms and conditions of any suppliers that are applicable to your booking arrangements. The lead guest is required to provide contact information to Traveling with Charisma for each guest in their group and assumes the responsibility of sharing these terms and conditions with the entire group, including payment of all amounts when due. It is the responsibility of each passenger to read  Traveling with Charisma Terms and Conditions in its entirety. In addition, Traveling with Charisma reserves the right to modify these Terms and Conditions, from time to time and will submit an update via email notifying of such changes. By reviewing this full Agreement and clicking “Agree,” I agree to the following terms and authorize Traveling with Charisma to charge the credit card I have provided.
RESERVATIONS: Please check your documents when you receive them. You agree to review your itinerary and other travel documents for accuracy and to inform us promptly of any issues. There will be a Trip Details Confirmation form that must be completed and signed confirming review of the itinerary. The names on your documents must match your government-issued ID. Call or email us if you have any questions.
IDENTIFICATION: Guests are required to make reservations in the EXACT full name that is listed on his/her government document they will use for travel. If you need to make any changes to a name after travel documents have been issued, clients will be responsible for all name change fees, if applicable. All passengers must present accepted photo identification such as a passport or other state or government--issued photo. IMPORTANT FOR DOMESTIC AIR TRAVELERS: The Federal Real ID Act mandates stricter security standards for state-issued driver’s licenses and other forms of identification and prohibits Federal agencies from accepting for official purposes identification that does not meet these standards. Beginning on May 7, 2025, every air traveler will need to present Real ID-compliant identification to be permitted to board a domestic flight; therefore, those holding a non-compliant driver’s license will need to present an acceptable alternate form of identification, such as a valid U.S. passport. To avoid disruption to their travel plans, air travelers are strongly encouraged to consult with the Department of Homeland Security (www.dhs.gov/real-id) to determine whether their state-issued identification is Real ID-compliant and, if not, what alternate forms of identification will be accepted at the airport.

AGENT FOR SUPPLIERS: Traveling with Charisma acts as sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in your itinerary or confirmation (“Suppliers”). We are not responsible for the acts or omissions of the Suppliers or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. You acknowledge that your travel plans may be interrupted or cancelled by the Supplier, a government entity, or other third party over which we have no control. You further acknowledge that the Supplier's own cancellation, rebooking and refund policies, subject to any applicable law that is now or may later be in effect, will govern your rights and remedies, including your right to receive a refund, including the refund timeline. We have no special knowledge regarding the financial condition of the Suppliers and no liability for recommending a trip credit in lieu of a refund.
PASSPORTS AND VISAS: You must have a passport book for air travel to another country; a passport card is NOT sufficient. Passengers are responsible for ensuring that they have the proper travel documents and MUST CHECK with the respective consulate(s) or a visa agency to determine whether any visas or passports are required. Passports are required to be valid for at least 6 months after the date of travel. It's also recommended to have two blank pages as well. Some countries require a full blank “VISA” page in the passport for stamping purposes. Any information provided on travel description pertains to US citizens only. Non-US citizens should check with the respective consulate of the country(s) to be visited for current entry requirements. We strongly suggest all cruise passengers to have a valid passport in their possession while cruising. Some countries will not admit persons convicted of a crime. Some countries require both parents’ consent for minors to travel. You will be responsible to ensure there is nothing prohibiting you from traveling, such as but not limited to, legal issues, criminal history, etc. 
A damaged passport can hinder you from gaining entry as well. A passport is considered damaged and may not be used if “The passport has been materially changed in physical appearance or composition, or contains a damaged, defective or otherwise nonfunctioning chip, or includes unauthorized changes, obliterations, entries or photographs, or has observable wear or tear that renders it unfit for use as a travel document”. Damage includes, but is not limited to: bite marks; torn, missing, or separated pages; water damage; holes and other damage rendering text illegible or photos distorted; the binding has come loose or is frayed.
 TRAVEL INSURANCE: Missing a vacation is bad enough. Losing the money you paid for your vacation is even worse. Therefore, we highly recommend  the purchase of travel insurance that helps provide coverage for, but not limited to, Trip Cancellation, Interruption, Baggage Loss or Delay, Medical Expenses and more. When traveling outside of the country US Medical Insurance is not accepted in other countries, and should you become sick or injured, you will be liable for any associated costs. I partner with Allianz Travel Insurance and Travel Insured International to provide travel insurance options. If you elect to purchase travel insurance, the terms of the policy will dictate whether, and to what extent, coverage for any monetary loss may exist under the circumstances of a pandemic, pre-existing medical conditions, and other policy exclusions. Insurance premiums are NON-REFUNDABLE. PLEASE REVIEW  YOUR TRAVEL INSURANCE PLAN AS  THE POLICY WILL DICTATE IF YOUR CIRCUMSTANCE QUALIFIES FOR MONETARY REIMBURSEMENT. Please consult the insurance carriers directly for details. Trip insurance or waivers provided by the supplier may not offer insolvency coverage. No representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. You agree to hold us harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to Covid-19 or any other claim under the policy. I am not licensed to offer an in-depth review of insurance policy language, exclusions or limitations. Should you have questions related to travel insurance policies and procedures, contact the insurance company. 
TRAVEL DOCUMENTS: Provided full payment is received no later than your Final Payment Due date, travel documents and travel instructions will be sent via email and 14 days or earlier prior to travel. If paper documents are requested when e-documents are available, documents will be delivered via USPS approximately 14-21 days prior, and a fee of $30 will apply. A complete street address is required (no PO boxes).
CHILDREN: Accompanying adults are responsible for the safety of their children including providing any necessary safety equipment (such as infant/ child seats) where appropriate. Please note that many countries have adopted practices to prevent international abductions of children. If a person under the age of 18 years will be traveling with an adult other than his/ her parents, or with only one parent, a notarized letter written by the parents, or non-traveling parent, granting authorization to travel, including the dates of travel should be carried. 
TRAVEL PARTIES: You acknowledge and agree that by making any payments to any travel reservations that you are agreeing to be obligated for the full amount of the travel services provided in your invoice. In the event that you are traveling with a travel companion that subsequently decides not to travel, for any reason, or abandons or leaves the vacation mid-travel, you are still responsible for the full cost of all items (i.e. the room, excursions, transfer, etc.), and any changes. This includes the costs of any increase or decrease of the members of your travel party. Cancellations and changes will be subject to the provisions in this Agreement related to changes and cancellations, including the fees associated therewith. You further acknowledge that some services are required to be purchased by all members of a travel party sharing accommodations, and you are responsible for the full amount purchased whether or not shared by some or all of the members of your travel party.
OCCUPANCY DECREASES AND NO SHOWS: If the number of individuals occupying a room decreases, the remaining travelers will be responsible for additional costs incurred as a result of a change in the per person occupancy rate.
TRAVEL AGENCY FEES: In order to honor the time spent researching and creating your travel itinerary, I charge a fee. This fee will confirm me as your agent for one trip and cover my services from the planning stage through the end of your trip. This fee is NONREFUNDABLE and DOES NOT count towards the cost of your trip, unless specified by the agent for promotional/marketing purposes only. The initial consultation is free. Only when you decide to move forward and secure my services, will I charge a fee. All quotes include:  Airfare, two (2) accommodation options, ground transportation (airport transfers, car rental, train), and Traveling with Charisma support before, during, and after travel. You also have the option to add on an Activity Package (up to 2 activities) or a Full Daily Itinerary Package. The selected activities will be for all travelers. If further customization is needed, please contact me as additional fees may apply. A "Multiple Destinations" trip is defined as needing lodging in another city or country, in addition to the first destination. Traveling with Charisma will work to create an itinerary that you love. If you'd like to tweak the preliminary itinerary, I am happy to do so, as long as the destination does not change or any major date changes. Destination or date changes that require additional research may result in another fee.
I also create customized Land + Cruise itineraries. If you only need a pre-cruise hotel the night before your cruise, the above cruise rates apply. For a longer land trip before or after a cruise, please contact me so we can discuss your travel needs in further detail.
Following submission of the fee, please allow 5 business days (for single destination) or 7 business days (for multiple destinations) to receive a preliminary itinerary. The client has 14 calendar days from the original proposed itinerary delivery to respond to the itinerary with confirmation of wanting to proceed or not. Following this 14-day period, if significant research is required again, additional fees may apply. 
By paying the agency fee, you acknowledge that the fee is non-refundable. In addition "domestic" as mentioned in these terms and conditions, forms, website, etc. refers to the Continental United States (including Alaska, but excluding Hawaii). 
PAYMENTS & CANCELLATION Deposit: A deposit is due at the time of reservation. All deposits are non-refundable and non-transferrable. All reservations (except where specified) will require a deposit and will be clearly noted the amount due and monthly payment plan. Final payment is required no less than 30 days prior to departure unless otherwise stated. The payment must be in a form accepted by the supplier. This information will be providing prior to booking. Full Payment: All reservations can be paid in full at time of booking. Traveling with Charisma does not “keep” payments on behalf of clients.  When a traveler submits a credit card authorization, Traveling with Charisma makes the payment directly to the hotel, cruise, tour, or activity supplier.  The travel agent never receives monies directly from the client except for the agency fee. Late Payment: If there is any outstanding balance by the Final Payment Due date listed on your invoice, a late fee will automatically be added to your invoice one day after your final payment date. Late fees vary. Reinstatement of Reservations: If your travel reservations have been cancelled, and you notify us within 14 days that you want to reinstate your reservations, a service reinstatement fee of $50 will be added to your invoice and must be paid in advance in order to apply for reconfirmation of services. Last Minute Reservations: All reservations made within 30 days of travel will require full payment upon booking. Form of Payment: Major credit cards or debit cards only. All payments made within 30 days of departure must be made by credit or debit card only. Credit card charges will be accepted by phone or online to fulfill the non-refundable deposit required. There is a $50 fee for all dishonored transactions. Refunds: If you purchased Travel Insurance through any carrier, you will need to go through the process of your selected carrier.  Cancellation: Once reservations have been made, cancellations will only be accepted in writing. Email your cancellation request to charis@travelingwithcharisma.com with your invoice number, full name, and date of travel. If you do not receive an acknowledgment within 48 hours, please call (302) 214-0614 to ensure your information was received. Cancellations may incur a $100 fee, in addition to the loss of the deposit. Reservation Changes: Changes to an existing reservation, whatever the cause, may incur a $50 per person charge plus any additional supplier fees. This includes name changes* and removal of any services such as optional tours and transfers. *Please note that name changes to airline reservations are subject to full cancellation and rebooking. Replacing a traveling passenger with another traveling passenger constitutes a cancellation, subject to cancellation penalties, and is not covered by this Reservation Changes policy. Changes or additions after departure are subject to local rates at the time of amendment and must be paid directly by the passenger to the service provider. There are no refunds for unused services.
PRICING: Prices do not include items of a personal nature such as laundry, wines, water, beverages, food (other than at all-inclusive resorts or where clearly specified), passport and visa fees, insurance, and foreign port taxes unless specifically indicated in the package inclusions. Prices are correct at time of publication; however, as airfares continually fluctuate and classes of service may have limited capacity, tour package prices and availability will change accordingly. In case of human or computer error, Traveling with Charisma reserves the right to re-invoice for the correct price or service. A full refund will be made to passengers who choose not to pay an increase, provided Traveling with Charisma receives a written cancellation within five days of the price increase notification.
CREDIT CARD TRANSACTIONS: Should you wish us to charge your credit card, we will require you to read and sign a credit card authorization form set out in the receipt. If for any reason, any travel service provider is unable to provide the services for which you have contracted, your remedy lies against the provider, and not against Traveling with Charisma, and in the event that payment has been made to Traveling with Charisma by credit card, you agree that you will not seek to chargeback your payment to Traveling with Charisma. If the credit card is passed through to the travel service provider and you seek to recover your payment from the provider, you agree to be held liable and indemnify Traveling with Charisma against this chargeback from the provider, including without limitation any air debit memos charged to Traveling with Charisma. If Traveling with Charisma incurs any costs, including but not limited to attorneys’ fees to recover any payments charged back by your credit card company, you agree that you will be liable for these costs. If the credit card is declined, you guarantee that you will settle any amounts owing to Traveling with Charisma via money order or cash immediately. If the payment is not resolved in a practicable amount of time, Traveling with Charisma will pursue legal action. 
FORCE MAJEURE: There may be times when either party are unable to perform, or complete performance, under the travel contract for reasons out of each other’s control. These are called force majeure events and if occurs, make performing under the contract inadvisable, commercially impracticable, illegal, or impossible. Events that may trigger this provision include, but are not limited to, acts of God, acts of government, acts of war or civil unrest, insurrection or revolts, military action, strikes or other labor activities, criminal or terrorist activities of any kind, or the threat thereof, pandemics, epidemics, illnesses or health conditions prevalent in the area of travel, earthquakes, hurricanes, lightning, and explosions, unexpected legislation, or any other event outside the reasonable control of either party. In the event that a force majeure event occurs, the parties will look to and follow the cancellation policies of the suppliers, what is stated in the travel proposal and these terms & conditions. Any changes to those policies are at the sole discretion of the supplier (if applicable) and Travel Agency. Passenger will be informed of their options if a force majeure event occurs.
INTERNATIONAL TOURS: Hotels, sea and river cruises outside of the United States are not required to comply with ADA requirements and therefore may not have ramps, wide entryways or elevators to accommodate disabled passengers or devices such as wheelchairs, walkers and motorized scooters. Due to physical constraints and space limitations, wheelchairs, walkers and motorized scooters may not be taken aboard motor coaches and river cruises. Service Animals: Service animals cannot be accommodated on international escorted tours. Passengers on USA escorted tours who require a service dog because of a disability should check with Traveling with Charisma prior to booking a tour.
HOTEL & TOUR IMAGES: Traveling with Charisma is not held responsible for the images portrayed in the marketing descriptions of Hotels, Resorts, Cruise Ships, Tours, etc. Hotel, Resorts, Cruise Ships and Tours may appear differently than listed on the supplier’s websites or marketing material. It is the client’s responsibility to search various avenues to view what the property, cruise ship or tour may look like.
AIRLINES: Traveling with Charisma is not responsible for the services and policies imposed by the airlines. Airline schedules and flights are subject to change without notice. Traveling with Charisma is not responsible for penalties incurred for tickets, international or domestic, not issued by Traveling with Charisma. Airline Tickets: Once full payment is received; Traveling with Charisma airline tickets will be issued and are fully non-refundable. Should airline tickets require to be issued earlier than the Final Payment due date, you may be required to pay a larger non-refundable deposit and/or complete full payment. Airline Seat Assignments: The airlines bear sole authority of assigning seats on group flights. All Traveling with Charisma airline contracts are for economy class seats only. If you require another class of service, you may consider purchasing your own flights and purchasing your land only package from Traveling with Charisma. Airline Frequent Flier Programs: Passengers are responsible to contact their airline directly regarding mileage eligibility and accrual. Airline frequent flier programs determine whether to award miles in part or total based on their own rules which are updated frequently. Some discounted or promotional airfares, as well as some code-share flights, are not eligible for mileage accrual. Some private airfares, such as a "Traveling with Charisma Airfare", are not eligible for mileage or may qualify for reduced mileage, even if the same airline class of service is eligible for full mileage when sold as an "Instant Purchase" published airfare. Not all published airfares are eligible for mileage. Traveling with Charisma will record frequent flier numbers when provided by the passenger prior to travel documents being issued. However, the addition of frequent flier numbers to airline records does not guarantee mileage eligibility which is at the sole discretion of each airline. Airline schedule changes may result in flights which were originally eligible for mileage accrual no longer being eligible. We highly recommend passengers to provide their frequent flier account information whenever checking in online and/or at the airport check-in desk. After travel has commenced, it is often not possible to apply for frequent mileage credit. Passengers are also responsible to determine whether previously earned mileage may be applied to flights to secure upgrades. Contact Information: Pursuant to TSA Secure Flight requirements, passengers are responsible to provide Traveling with Charisma with their name as it appears on their passport (or other government-issued I.D. when traveling), date of birth, gender, address, phone number, email and fax data for all passengers. Passengers must ensure that names are correctly listed on their invoice. Traveling with Charisma will not be responsible for passengers who do not receive an invoice or documents or are denied boarding due to inaccurate information. Airline Name Changes: Any name change including minor spelling corrections may require airline reservations to be canceled and rebooked. Reservations are subject to current availability and pricing at the time of rebooking. Once airline tickets are issued, subsequent name corrections will be subject to an airline rebooking fee which may be as much as the full value of the airline ticket plus a $50 revision fee per change. Traveling with Charisma will not be held responsible for the denial of services by a carrier due to any name discrepancy. Name changes must be advised in writing at charis@travelingwithcharisma.com. Airline Taxes & Fuel Surcharges: If you purchased airfare, airline taxes and fuel surcharges are included. Prior to completion of full payment, there is a potential for a price increase(s) due to increases in government- levied taxes and fees and/or fuel surcharges. To avoid potential increases, you may choose to accelerate your final payment in order that your tickets may be issued. Once issued, airline tickets are no longer subject to potential increases but are fully non-refundable. Certain overseas domestic flights are subject to air taxes which can only be paid locally; in these cases, the specific flights and amounts of those taxes are indicated in our package presentation and pre-departure.  Schedule Changes: In the event of an airline schedule change, Traveling with Charisma will make every effort to inform passengers of the schedule change and new flight schedule prior to departure. Traveling with Charisma is not responsible for schedule changes including, when applicable, changes in routing and/or the number of stops in the itinerary. Traveling with Charisma is unable to provide compensation for schedule changes, seat assignment modifications, or cancellations implemented by an airline. In the event of any change in flight itinerary made directly between passengers and their airline, it is the passengers' responsibility to advise Traveling with Charisma of amended flight details in writing at charis@travelingwithcharisma.com. Traveling with Charisma cannot be held responsible for land services, including arrival and/or departure transfers, if flights are changed without its knowledge. Flight Confirmation: We strongly suggest that clients reconfirm exact flight times with the carrier prior to departure. Air travelers are required to check in at least 2 hours prior to departure time for domestic flights and 3 hours for international flights and must report to the gate at least 30 minutes prior to departure time. Failure to comply may result in the loss of the seat to another passenger. Health Requirements: Check with your healthcare provider for up-to-date requirements. You may also check the Centers for Disease Control (www.cdc.gov) and/or the World Health Organization (http://www.who.int/en/) for their recommendations. Required inoculations, if any, must be recorded by clients' health practitioner on a valid vaccination certificate which the client must carry for proof of inoculation where required. All costs associated with medical treatment and related expenses such as additional hotel nights or transportation not included in the original itinerary will necessarily be borne by the passenger. Please note that some countries may require aircraft cabin insecticide treatment for in-bound foreign flights. A list of such countries is available at: http://www.dot.gov/.../avi.../aircraft-disinsection-requirements. Luggage (Airlines): Checked bags are typically limited to a total dimension of 62 inches by adding length + width + height (example: 26"+26"+10" = 62”), and a maximum weight of 50 lbs (23kg). Many airlines apply charges for checked bags and we recommend visiting the airlines website to review their baggage fees and specifications. Traveling with Charisma is not responsible for checked bag fees, excess luggage or weight charges levied by an airline. If your luggage is lost or damaged by the airlines, a baggage claim form MUST be filed with the carrier before leaving the airport. We recommend that you use brightly colored luggage tags, straps or other identifiers to help you locate your luggage upon arrival or to describe it if it is lost. 
CRUISES: Ship & Itinerary Changes: Cruise itineraries and ships are subject to change without notice. Furthermore, cruise ships may be chartered and/ or departure dates canceled, in which case all monies will be refunded. Traveling with Charisma takes no responsibility for ship substitutions or itinerary changes imposed by a cruise line and is not responsible for any losses you may incur including the issuance and/ or cancellation of airline tickets or visa fees. Medical Services: Many ships do not carry a doctor or nurse onboard. Should medical attention be required, local services will be contacted. Resulting charges will be the responsibility of the passenger. Traveling with Charisma and the cruise ship operator are not responsible for the services provided.
 RELEASE FROM LIABILITY: Traveling with Charisma does not own or operate any entity which is to or does provide goods or services for your trip including, for example, ownership or control over hotels or other lodging facilities, airline, vessel, bus, van or other transportation companies, local ground operators, providers or organizers of optional excursions or equipment used thereon, food service or entertainment providers, etc. All such persons and entities are independent contractors. As a result, Traveling with Charisma is not liable for any negligent or willful act or failure to act of any such person or entity, or of any other third party. Without limitation, Traveling with Charisma is not responsible for any injury, loss, or damage to person or property, death, delay or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to, acts of God, acts of government, force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, or the threat thereof, overbooking or downgrading of accommodations, structural or other defective conditions in hotels or other lodging facilities, mechanical or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely or safely, dangers associated with or bites from animals, pests or insects, marine life or vegetation of any sort, dangers incident to recreational activities such as swimming, kayaking, sailing, canoeing, rafting, hiking, walking, bicycling, etc., sanitation problems, food poisoning, lack of access to or quality of medical care, difficulty in evacuation in case of a medical or other emergency, illness, epidemics or the threat thereof or for any other cause beyond the direct control of Traveling with Charisma. In addition, I release Charis Murray and Traveling with Charisma from its own negligence and assume all risk thereof. 
I hereby expressly assume all of these risks and dangers, and I hereby expressly agree to forever release, discharge and hold us, and our agents, employees, officers, directors, associates, affiliated companies, guides, group leaders, and subcontractors harmless against any and all liability, actions, causes of actions, suits, claims, and demands of any and every kind and nature whatsoever which you now have or which may hereafter arise out of or in connection with these risks and dangers.
REFUSAL OF SERVICE: Service providers reserve the right to refuse service to travelers at their sole discretion, including, without limitation, if the traveler: (i) Lacks proper documentation for the country of destination; (ii) Has a contagious disease; (iii) Is under the influence of alcohol, drugs, or narcotics; and/or (iv) Manifests disruptive and/or unruly behavior. Traveling with Charisma assumes no liability for the acts of the service provider in refusing service.
ASSUMPTION OF RISK: Traveling with Charisma assumes no responsibility for and shall not be liable for the acts or omissions on the part of any other party not under our control or any acts of God, unsafe conditions, terrorism, health hazards including pandemics, illness, weather hazards, or the suitability for a disabled person of any portion of any trip. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov, click on "Find International travel Information” then click on "Country Information", and fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country. For destination information specific to COVID-19, we recommend visiting IATA's COVID-tracking site here in addition to the State Department site. It is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of COVID-19. Ultimately it is your responsibility to understand and abide by all requirements and restrictions when traveling. This may include the following: health affidavit forms; health screenings prior to departure and/or upon arrival; temperature screenings prior to departure and/or upon arrival; travel reason affidavit forms; online travel authorizations; airline safety & health requirements, such as health forms, screenings, face coverings; in-country requirements, such as periodic temperature checks, quarantine, face coverings; visas. Failure to meet the requirements and/or restrictions puts you at risk for fines, quarantine or deportation at your expense.
BINDING ARBITRATION: I agree that any dispute concerning, relating or referring to this Agreement, the brochure or any other literature concerning my trip, or the trip itself, shall be resolved exclusively by binding arbitration pursuant to the Federal Arbitration Act, 9 U.S.C. §§1-16, either according to the then existing Commercial Rules of the American Arbitration Association (AAA) or pursuant to the Comprehensive Arbitration Rules & Procedures of the Judicial Arbitration and Mediation Services, Inc.
